This website is operated by Heirbloom A. & D. Jones GbR (“Heirbloom”). Throughout the site, the terms ‘we’, ‘us’ and ‘our’ refer to Heirbloom. Heirbloom offers this website, including all information, tools and services available on this site, to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our website and/or purchasing something from us, you use our ‘Service’ and agree to be bound by the following terms and conditions (‘Terms and Conditions’, ‘Terms’), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms & Conditions apply to all users of the site, including without limitation users who are visitors, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms & Conditions carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms & Conditions. Our shop is hosted on Shopify Inc. Shopify provides us with the online e-commerce platform that enables us to sell our products and services to you.

In the following terms and conditions, reference is made to the German Civil Code (BGB) insofar as German law applies.

1. Scope

These General Terms and Conditions (GTC) apply to all contracts concluded via the online shop of Heirbloom (hereinafter ‘seller’) at heirbloom.eu between us and our customers (hereinafter ‘customer’). The terms and conditions apply to both consumers within the meaning of § 13 BGB (German Civil Code) and entrepreneurs within the meaning of § 14 BGB within the European Union (EU).

3. Conclusion of contract

(1) The presentation of products in our online shop does not constitute a legally binding offer, but an invitation to place an order by the customer.

(2) By clicking the order button, the customer submits a binding purchase offer.

(3) The offer is accepted either by an explicit order confirmation by e-mail or by sending the goods.

(4) In case of advance payment, acceptance is made by a request for payment.

(5) The seller reserves the right to refuse orders or to withdraw from the contract without justification, in particular if:

  • The customer has violated the terms and conditions in the past,
  • payment defaults are known or
  • there is suspicion of improper use of the shop.

4. Prices, terms of payment and invoicing

(1) All prices are quoted in euros (EUR, €) and include VAT.

(2) If prices are displayed in a different currency due to the localisation of the website, the invoice amount for an order will ultimately still be displayed in euros.

(3) The prices for our products are subject to change without notice.

(4) Shipping costs are shown separately (see Shipping Policy). The shipping costs are clearly indicated in the shopping cart system and on the order page.

(5) Payment can be made by credit card, PayPal or other payment methods offered in the shop.

(6) The customer is obliged to provide complete and correct information for all purchases made in our shop, in particular for billing and account data. This applies, among other things, but not exclusively, to the email address, billing and delivery address, payment data or other necessary information, so that a smooth processing of orders can be guaranteed.

5. Terms of use and customer obligations

(1) By agreeing to these terms and conditions, the customer confirms that they are at least the age of majority in their country of residence or that they are of legal age and have given the seller permission for their minor dependents to use this website.

(2) The customer is obliged not to use the seller's products or services for illegal or unauthorised purposes and not to violate any laws in their respective jurisdiction (including, but not limited to, copyright laws).

(3) The customer is prohibited from transmitting viruses, worms or any other malicious code.

(4) Any breach of these terms may result in immediate termination of services by the seller.

6. Disclaimer and product presentation

(1) The seller does not guarantee that the information provided on this website is correct, complete or up to date. The material provided on this website is for general information purposes only and should not be used as the sole basis for decision-making without checking primary, more accurate, more complete or more up-to-date sources of information. Reliance on the information on this website is at the customer's own risk.

(2) This website may contain historical information that is no longer current and is provided for your reference only. The seller reserves the right to modify the contents of this website at any time, but does not undertake any obligation to update any information that it makes available. It is the customer's responsibility to check this website periodically for changes.

(3) Certain products or services may only be available online through the online store. These products or services may only be available in limited quantities and are subject to the return or exchange policy in accordance with the seller's return policy (see 11. Right of withdrawal).

The seller also reserves the right to limit the quantity of products or services offered. All product descriptions or prices are subject to change without notice. The seller reserves the right to discontinue any product at any time.

(6) The seller does not guarantee that the quality of the products, services, information or other materials purchased by the customer will meet the customer's expectations or that errors in the services offered will be corrected.

6. Errors, inaccuracies and omissions

(1) Occasionally there may be an error in typography, inaccuracies or omissions in relation to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability.

(2) The Seller reserves the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. If an order has already been placed and is affected by an incorrect specification, the customer will be informed immediately and has the right to cancel the order.

7. Disclaimer for service interruptions

(1) The seller does not guarantee that access to the website or the services offered will always be uninterrupted or error-free.

(2) The seller reserves the right to restrict the website or certain services temporarily or permanently without prior notice, provided that this is necessary for technical, economic or legal reasons.

(1) The seller may provide the customer with access to third-party tools that cannot be monitored or influenced. These tools are provided ‘as is’ and ‘as available’, without any guarantees or liability on the part of the seller. Use is at your own risk.

9. User comments and feedback

(1) The customer grants the seller the right to use and publish submitted comments or suggestions without restriction, without obligation for compensation or response.

(2) The seller reserves the right to remove comments that violate applicable law or the rights of third parties.

(3) The customer is responsible for the legality and correctness of his comments.

10. Delivery terms

(1) Delivery is within the EU.

(2) If an ordered product is not available, the customer will be informed immediately.

(3) Further details on the delivery conditions are described in the Shipping Policy.

11. Right of cancellation

(1) Consumers have the statutory right of cancellation of 14 days in accordance with the EU Consumer Protection Directive.

(2) If you, as a consumer, make use of your right of cancellation in accordance with (1), you shall bear the regular costs of the return shipment.

(3) The details of the right of cancellation are included in the Refund Policy.

12. Retention of title

(1) The goods remain the property of the seller until full payment has been received.

13. Warranty and liability

(1) The statutory warranty rights apply in accordance with § 434 BGB.

(2) The seller is only liable for intent and gross negligence, except in the case of injury to life, limb or health.

(3) Liability for slight negligence is limited to foreseeable, typically occurring damage.

14. Data protection

(1) Personal data is processed in accordance with the General Data Protection Regulation (GDPR).

15. Dispute resolution & online dispute resolution (OS)

(1) The responsible consumer arbitration board in Germany is: Universalschlichtungsstelle des Bundes Zentrum für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de.

(2) The EU Commission provides a platform for online dispute resolution (ODR) until 20 July 2025: https://ec.europa.eu/consumers/odr. After that, the platform will be discontinued. The last date for submitting new complaints via the OS platform is 20 March 2025. Consumers can find out about alternative dispute resolution procedures at national level.

(3) We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

16. Final provisions

(1) These terms and conditions are governed by the laws of the Federal Republic of Germany, excluding the UN Sales Convention.

(2) If the customer is an entrepreneur, the exclusive place of jurisdiction is the District Court of Dannenberg (Elbe) (for disputes over €5,000, the District Court of Lüneburg).

(3) Should any individual provisions of these terms and conditions be invalid, the validity of the remaining provisions shall remain unaffected.
